2001 NEGFA Supports LB435 RR Lease Disputes
LB435 The Agricultural Suppliers Lease Protect Act allows agricultural leaseholder to file a complaint with the NE Dept. of Ag. if any lease controversy with their railroad landlord or successor in interest cannot be resolved by negotiation. "Dramatic lease increases can quickly become a real economic issue to many small and medium elevators or feed mills. ... I'm not against railroads receiving a fair value for their land. What I am concerned about is they seem to feel that they can charge whatever they like because these companies (elevators) cannot afford to move or abandon their investments."

2002 Julie Wilhelm Elected VP of NEGFA
Julie Wilhelm elected as vice president of NEGFA. She will succeed Mike Wyatt elected President in July 2002. She also becomes the first woman elected in the organization's 106-year history and is only the second person from Humboldt to hold the office. John R. Cooper served as VP and President of the NEGFA from 1968-1969.

2002 LB435 Nebraska Legislature Passes Ag Lease Protection Act
LB435 the Agricultural Suppliers Lease Protection Act passed Nebraska Legislature. The bill originally introduced in 1999 on behalf of NEGFA after the Association reported an increase in calls from members who had received their regular lease renewal notices from land management companies who had taken over the property without the elevator's knowledge. Many facilities reported conflicting terms and proposed lease increases four times the current rate.

2003 LB735 Governor Signs Grain Law Rewrite
LB735 extends Nebraska Public Service Commission (PSC) protections to additional merchandising activities, develop a schedule fo fines to address certain and repeated violations of state warehouse laws, increase random inspections and fines for repeat violators and better monitor out-of-state grain dealers. An additional change will require a dealer's license for any state-licensed warehouse that buys, sells, or transports grain not received at its licensed grain facility. This will require state licensed warehouses who engage in both warehousing and destination deliery of grain to have both licenses.

NE Legislature bracketed Ag Suppliers Lease Protection Act, LB435, until January 2002. Besides philosophical problems Lincoln Senator ChrisBuetler had with the bills creative negotiation concept, Ptacek said that the NEGFA could never agree to his original demands that a railroad's successor in interest be removed from the bill, or to exempt any property leased prior to the effective date of the act. "These are the root causes of the costly problems our members are experiencing today," said Ptacek.

NEGFA Applauds Revised Union Pacific Demurrage Policy (2000)
The Union Pacific (UP) Railroad has decided to alter their demurrage policy in light of concerns expressed by NEGFA, other state grain and feed associations, and the National Grain and Feed Association. In January, UP will implement a new computer program for better tracking of constructive-placement and actual-placement of grain cars.

NEGFA Opposes Harkin Farm Bill (2001)
NEGFA President Tim Gubbels of North Side Grain in Laurel, said it is critical the Senate delete the entire "agricultural competition" section of the bill. "If passed the legislation would drive competitive buyers away from ag markets, leaving farmers with fewer farming opportunities and fewer marketing vehicles for their production.

NEGFA Plans Summer Meetings on Rail Lease Protection Act LB435 (2001)
LB435, Agricultural Suppliers Lease Protection Act, did not pass the legislature. The bill is bracketed until 2002. Bob Kelly, NEGFA President and General Manager of Crossroads Cooperative in Sidney, said that while LB435 did not pass, just raising the issue has had a positive effect for many agricultural tenants.
