Despite expectations that OSHA enforcement would fall significantly under the Trump Administration, the reality has been quite the opposite.  OSHA has not backed down from its enforcement mission, and in many ways, has even strengthened it.  For example, in a May 2018 Memo, OSHA announced that it may use drones – for the first time ever – during inspections to collect evidence, including in areas that may have previously been inaccessible or dangerous for inspectors.  Furthermore, in late October 2018, the agency launched its new Site-Specific Targeting (SST) Enforcement Program, which outlines how the agency will select non-construction establishments for programmed inspection based on the data it collected under its new E-Recordkeeping Rule.  And finally, OSHA launched a new Regional Emphasis Program (REP) on the hazards of exposure to fertilizer grade ammonium nitrate and agricultural anhydrous ammonia.  The REP became effective October 1, 2018, and covers certain industries in the states of Arkansas, Louisiana, Oklahoma, and Texas in OSHA Region VI, and Kansas, Missouri, and Nebraska in OSHA Region VII.  These are only a few examples demonstrating how, if anything, OSHA is making it more likely for it to come knocking and issue citations.
