NGF DEVELOPS NEW CONTRACT FOR DIRECT DELIVERY & DEFERRED PAYMENT FOR DIRECT DELIVER GRAIN Over the past couple of months, the Nebraska Grain and Feed Association (NGF) has received several calls from grain dealers who were concerned about offering producers the appropriate commodity contracts for direct delivery transactions. Other dealers were informed during recent Nebraska Public Service Commission (PSC) audits that they were using incorrect deferred payment contracts for direct delivery transactions. More and more in today's changing marketplace, elevators and grain dealers are shipping commodities direct from the farm to feed lots and ethanol plants, and the contracts governing these transactions are important tools to protect themselves. Working with the grain department staff at the Nebraska Public Service Commission (PSC), NGF has developed two new direct delivery contract forms. The first contract, NGF Form 107 © covers traditional direct delivery obligations. The second contract, NGF Form 104 D © is a redesign of a deferred payment contract that address direct delivery transactions. Dealers were using Form 104 for their deferred direct deliver transactions, however, Form 104 is intended only for the deferred payment of warehouse stored grain.
